(The Post News)– A prominent former member of the MK party, Jabulani Khumalo, lost his bid and has been denied reinstatement on the list of parliamentary candidates for the Umkhonto Wesizswe Party after a legal setback against the party this week.
The decision taken comes as a blow to Khumalo, who has been contesting his return to the MK party after expulsion. Khumalo was expelled for allegedly working against the party and for misconduct.
As the founder of uMkonto weSizwe, Khumalo contacted the Western Cape High Court for his reinstatement as a member of parliament, but his case was uncovered as lacking urgency and substance.
Khumalo claimed in his court papers that his signature was forged by Duduzile Zuma-Sambudla, and he sent a letter to the commission asking for his name to be removed from the party’s particulars.
He claimed that since the letter sent to the electoral body is not from him but a federal rule also known as Regulation 9 of regulations for the registration of political parties, the IEC asserted dominance by acting on the request sent by Zuma using the alleged fraudulent request letter. Judge Lebogang Modiba believes Khumalo’s version of events was full of contradictions.
“A punitive costs order against Mr. Khumalo is the most appropriate way of ensuring Mr. Khumalo’s conduct and sending a message to the public that making false statements under oath and abuse of this court’s process will not be countenanced,” stated Modiba.
The outcome of the alleged fraudulent letter sent by Zuma-Sambudla led to an announcement that she was meeting her lawyers and building a case of defamation against Khumalo with the intention of holding him accountable for the behaviour and distress he is causing.
Khumalo’s fate serves as a reminder of the challenges and complexity that emerge in political parties.
