MK Party leader, Jacob Zuma’s Legal Team Challenges ANC Expulsion Over Alleged Violations of Procedure and Rights.
(The Post News)- The African National Congress (ANC) received a letter from uMkhonto weSizwe (MK) party leader President Jacob Zuma’s legal team, challenging his expulsion. He was expelled in November by the ANC’s National Disciplinary Committee of Appeal (NDCA) over the betrayal of the party’s values. Zuma’s legal team claims procedural failures and inconsistent application of rules were the reasons for his expulsion.
The letter demanded that his expulsion be immediately reversed and asked for the complete record of the disciplinary hearings and a reasoned ruling from the NDCA, which they have repeatedly requested but have not received.”This expulsion violates his rights, and we are prepared to take all necessary legal steps to ensure justice,” his legal team stated. Zuma’s legal team has set a deadline of January 31, 2025, for the ANC to address these issues. Failure to comply will result in Zuma approaching the courts to seek reinstatement and punitive costs.
His team indicated their intention to seek court intervention to reinstate his ANC membership and to secure punitive costs against the party.
The ANC, in a statement released on November 22, 2024, defended the expulsion as a necessary step to uphold the party’s integrity and discipline. The NDCA reaffirmed that Zuma’s actions, including his association with a rival political party, constituted gross misconduct and a betrayal of ANC principles. The statement further explained that Zuma abandoned the fundamental principles of collective accountability and organizational loyalty by founding and leading a competing political party.
He threatened legal action. If the ANC does not comply with his demands to be reinstated, he will challenge the legitimacy of the disciplinary process. The ANC has yet to respond publicly to the allegations or the ultimatum.
