Kilmar Abrego Garcia is ordered to be released. A U.S judge ordered the release on bail of Garcia on Sunday as he awaits his trial on immigrant smuggling charges. Kilmar Garcia, a Maryland-based migrant, was wrongfully deported to El Salvador earlier this year, despite court protections.
According to reports, the individual’s release does not necessarily indicate that he will be reunited with his family immediately, as he is likely to be placed in immigration detention following his release.
The judge, Barbara Holmes, ruled that Abrego does not pose a flight risk, saying “overall the court cannot find from the evidence presented that Abrego’s release clearly and convincingly poses an irremediable danger to other persons or the community” She added on to say “The court finds nothing in Abrego’s History that suggests that he is a flight risk… There is no allegation, much less evidence, that he has intentionally failed to appear in court in the past. Overall, the government simply has not shown a serious risk that Abrego will intentionally avoid appearing as required.”
Following his return to the U.S, he was charged with being an accomplice to illegally smuggling immigrants to the United States. Reports state that Prosecutors revealed that Abrego was involved in picking up migrants from the U.S.-Mexico border over 100 times, and additionally, he transported firearms and drugs.
Kilmar pleaded not guilty to the charges. Moreover, His legal team believes that the government only gave him the charges as a way of concealing the error of deporting him. Additionally, they alleged that the individuals assisting the government in this case are only doing so as an effort to avoid being deported themselves, so they might not be telling the truth.
A hearing to review the conditions of Abrego Garcia’s release and any other outstanding issues has been scheduled for Wednesday at 2 pm.
