Bester enjoyed being free till he was seen at Woolworths in Sandton mall shopping two months after he was declared dead. Where the ground up later published that he escaped prison and faked his death.
He wants the court to grant him a laptop in jail to prepare for his trial due to him arguing that his deportation was unlawful and he wants to challenge the lawfulness of his imprisonment and deportation arrest in Tanzania.
When news escalated that he faked his death and escaped prison, He then escaped the country with his girlfriend and was later arrested in Tanzania. Bester claims his deportation from Tanzania was unlawful due to false documents issued by Home Affairs, and now he’s questioning the legitimacy of his incarceration.
Essentially, he’s saying his entire detention process was flawed from the start. Bester, who chose to represent himself in court, is arguing that the false documents used to deport him render his deportation and subsequent incarceration invalid.
The Judge stated that she was gonna provide him with law books , Which will give him access to all the information he is seeking, however he will not be granted any laptop, Bester claimed that was his constitutional right to have access to a laptop.
The court asked him to show in the constitution where it says “he have the right to access to a laptop.”Bester said “ students inmates have access to laptops, so why can’t I get it too” the court asked if he was studying “Are you a student?
The court states that it will only give him access to law books and all the material he need, it will just not be electronic.”
The court noted that this isn’t Thabo Bester’s first time submitting an application of this nature, and it was concerned about the significant delay – over a month – between the initial urgent application date and the actual placement on the urgent roll.
Specifically, the court pointed out that Bester failed to provide a valid explanation for this delay and also didn’t justify why he couldn’t seek relief through the normal channels.
