(The Post News)– Former Sports, Arts, and Culture Minister Zizi Kodwa and his co-accused former Enterprise Outsourcing Holdings (EOH) Executive, Jehan Mackay, appeared before the Palm Ridge Magistrate’s Court this morning, where the corruption charges against them were withdrawn by the Director of Public Prosecutions.
Kodwa and Mackay were facing charges of violating the Prevention of Organised Crimes Act and the Prevention of and Combating of Corrupt Activities Act. Kodwa allegedly received about R1.7 million in bribes from Mackay in exchange for government contracts.
Both Kodwa and Mackay had made representations for the charges against them to be withdrawn. According to the spokesperson for the National Prosecuting Authority (NPA), Phindi Mjonondwane, the decision to withdraw the case was based on the accused’s successful representations to the Director of Public Prosecutions (DPP). Mjonondwane said the representations were evaluated alongside evidence in the case docket, reports from the prosecutor and the regional head of the Specialized Commercial Crimes Unit, and conversations with the officer in charge of the investigation.
Furthermore, Mjonondwane stated that when the NPA and DPP exercised their authority in accordance with their mandate and constitutional duty, he ensured fairness and transparency and that the decision he made was in the best interests of justice, taking into account the interests of both the accused and society. Mjonondwane also claimed that the NPA is unable to provide specifics about their representations, as well as the circumstances that influenced the DPP’s decision.
